In June 1992, business partners, Clinton and Selena purchased the freehold interest in a parcel of land called Greenacre in Trinidad. The total purchase price was $4,000,000 TTD, whereby Clinton paid $3,000,000 and Selena paid $1,000,000. The deed indicated that they are to hold the property together but made no mention of any type of co-ownership. In October 1995, Clinton created a will leaving his interest in the property to his brothers Nicholas and Alan to hold as tenants in common equally. This was quite timely as he soon passed away in January of 1996. In May of that same year, Selena transferred her interest in Greenacre by Deed to her three children - Anas, Kyra and Malaika who were teenagers at the time, as Joint Tenants. In September 2007, Anas got married and moved to Barbados. He needed money to purchase a house in Barbados, so he served notice on Kyra and Malaika of his intention to sever the tenancy and sell his interest to Nicholas. This notice was sent via registered post. Nicholas and Anas had a verbal agreement for the sale of Anas' interest in the amount of $500,000 in December 2007. Neither Kyra nor Malaika responded.
