This is true. It is known as popular sovereignty. However, if you look through history, we did not follow this concept. We claimed that any human being that was not white, was not equal. We claimed that they were inferior. They should not have had the same rights as a White man. So for the first part of Americas history, our officials were going against the basic principle of Constitution, the very reason the Constitution was written in the first place.
